By accessing our website or using our services, you agree to these Terms & Conditions.
These terms apply to all our services, including:

  • Virtual Employees

  • Remote Staffing

  • HR Services (India)

  • Recruitment & Talent Acquisition

  • Digital Marketing

  • SEO Services

  • Lead Generation

  • Web & App Development


1. Service Engagement

By purchasing or subscribing to any of our services, you agree to follow the terms outlined in:

  • Service agreements

  • Invoices

  • Quotation emails

  • Project scope documents


2. Client Responsibilities

The client agrees to:

  1. Provide correct and complete information.

  2. Share required login credentials & tools for service execution.

  3. Approve work, creatives, or candidates in a timely manner.

  4. Maintain platform access (Instagram, FB, Google, CRM, Website, etc.).

  5. Ensure legal use of all assets provided.


3. Payments

  • All payments must be made in advance unless agreed otherwise.

  • Staffing, SEO, and marketing plans are billed monthly.

  • HR recruitment fees follow the agreed percentage or fixed model.

  • Delays in payment may lead to suspension of services.

  • Payments made are for time, manpower, and effort, not specific outcomes.


4. HR Services & Recruitment Terms

A. Candidate Replacement

Replacement terms (if applicable) will be specified in the agreement.

B. Candidate Ownership

Candidates sourced by us cannot be hired directly for 12 months without paying the recruitment fee.

C. Verification

Clients are responsible for final background checks unless agreed in writing.


5. Virtual Employees / Remote Staffing

  • All virtual staff remain employees of TheBrightTechnologies.com.

  • Direct hiring, solicitation, or poaching is not allowed for 24 months.

  • Performance concerns must be reported to us for corrective action.


6. Digital Marketing & SEO Limitations

  • Due to the nature of algorithms and competitive environments:
  • No guarantee of specific followers, engagement, rankings, or revenue.

  • Results vary by niche, geography, competition, and budget.

  • Content or account restrictions caused by the client are not our responsibility.


7. Third-Party Disclaimer

We rely on third-party tools like Google, Meta, Instagram, CRM platforms, APIs, etc.
We are not responsible for:

  • Their downtime

  • Their policy changes

  • Account restrictions

  • Algorithm fluctuations


8. Intellectual Property

  • Content delivered after full payment (graphics, ads, videos, websites) becomes the client’s property.

  • Internal strategies, automations, systems, and templates remain our IP.


9. Refund Policy and Limitation of Liability,  

  1. General Policy

Due to the nature of our services—which involve time, effort, and human resource allocation—all payments made to us are final and non-refundable, except under the specific conditions mentioned below.

  1. Refund Eligibility

Refunds may be considered only under the following conditions, to be applied within 48 hours of Payment made:

  1. Service Not Delivered

A refund may be issued if:

  • The agreed-upon service has not been initiated at all, and
  • No work, resource allocation, or onboarding has taken place.
  1. Duplicate or Overpayment

If a client has been charged twice or has made an excess payment by mistake, the additional amount will be refunded.

  1. Non-Refundable Items

The following are strictly non-refundable:

  • Fees paid for sourcing, screening, or recruitment efforts already completed
  • Fees for hours worked by Virtual Employees / Remote Staff
  • Fees for Digital Marketing services already executed, including campaigns, ads, content, SEO, creatives, or consultations
  • Any third-party charges, including ad spend (Google, Facebook, LinkedIn, etc.)
  • Setup fees, onboarding fees, or service initiation fees.

We are not liable for:

  • Loss of business, revenue, or profits

  • Delays caused by client-side issues

  • Platform bans or algorithm issues

  • Candidate performance after onboarding

Maximum liability is limited to the amount paid in the last term of service.


10. Termination Policy

  • 30-day notice for staffing & HR outsourcing

  • 7-day notice for marketing or SEO plans

  • Immediate termination for non-payment, misuse, or breach of terms


11. Governing Law

These Terms are governed by the laws of India.
Any disputes will be resolved via Arbitration as per Indian Arbitration & Conciliation Act.
